Well, she won't be able to go after the company in China. Service via letters Rogatory is a real pain in the ass, assuming China is even a signatory to the Hague Convention on Service Abroad. I once had to sue Saudi Aramco on an unpaid commercial invoice of about $150K via letters Rogatory and it took months. I *DID* get them to pay in full by keeping a Saudi royal prince (and executive) tied up on a telephonic deposition long enough to jeopardize his tee time.
Anyway, the lady is going to have to look solely to Wal Mart. If she survives summary judgment proceedings, I suspect she will have a lot of sympathy with a jury, depending on the venue.
Its just too bad that all personal injury lawyer are evil, and that all personal injury victims are lying crooks just trying to get rich for nothing, just like this lady.
